Parking Charge Notice for collecting someone from a hotel

I picked up a friend from the Ox Hotel in Eccles, Manchester and for a 15 minute wait I've been sent a £100 charge notice by Euro Car Parks - this has come through the post and has times/dates and photos of the car

He did come down but unfortunately he'd forgotten something and had to go back in and collect his stuff, leading to a longer wait

I've contacted the hotel but because I wasn't staying there and wasn't the customer they are saying they can't help. Apparently they ask all guests if  they have come in a car and tell them about parking charges when they sign in but as I didn't go to reception this didn't happen

I didn't notice parking signage but as I didn't get out of the car I wouldn't have anyway

Entry time was 11:09:59 and exit time was 11:24:28 so actually under 15 minutes - but can't find anything that lists this as a public car park and there is nothing on the hotel website

Have tried to plow my way through the guides but my ADHD is making it really difficult to find the relevant information

Do I appeal online via Euro Car Parks or is this going to be a cut and dried case? I'd rather pay the £60 than flog a dead horse and end up paying the full £100

you wont pay the full £100 or any other amount.

you do need to read the newbies thread and use the correct terminology to appeal - no saying who was driving.

Get the friend who was a legitimate but tardy guest to complain about it to the hotel and get it cancelled , plan A

Its a private car park,  not a public car park,  so a private car park with legitimate access by the public

The BPA Code of Practice dictates consideration times, but as you were loading  ( a tardy passenger   ) then the Jopson case may apply

The chances are that the driver didn't see signage warning them to register their vehicle inside,  but it's a common Practice these days

I doubt that this would win at popla,  unless you can prove that the signage was poor and inadequate,  unlit etc

I believe that you would win in court, if it got that far,  which is unlikely

But your best option is to get that passenger to complain about it to the hotel and get it cancelled ASAP

You won't pay a penny even if you get a small claim next year. This us easy to defend if so.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
