You'd go into the circumstances in your Witness Statement, but that won't be applicable here because they'll discontinue before that stage (we're talking in a few months time).

No discussion needed with Smart Parking claims. All the same; we have hundreds here.
Literally:
1. copy any other Smart defence.
2. Bookmark and follow the 8 steps in the Template Defence sticky thread. Job done.
3. Discontinuance in 2026.
Have read the 8 steps so will await next contact and follow as guided there.

Hi guys,
Had my mediation.
5 minute call with no offer made.
Re the final court stage. From reading this forum I know there's a very high chance that DCB legal will cancel before paying court fee. I've been told it will be a 6-9 month wait for a court date.
However, I don't have the original Smart Parking PCN to prove they didn't follow POFA if it did happen to go to court.
Should I do a SAR request to get the original PCN in the meantime to gather as evidence just incase?

If you do, wait until a lot nearer to the hearing fee date in a few months time ( but I don't think that you will need to. )

No need. Smart know full well they NEVER EVER used POFA wording until a year ago.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
