Terms & Conditions - Best of Touring £5,000 Competition

Win £5,000 towards a touring holiday within Best of Touring Autumn/Winter 2025 (the “Promotion”) which is promoted by Hays Travel Limited whose registered office is at Gilbridge House, Keel Square, Sunderland SR1 3HA (Company Registration No. 01990682) (the “Promoter”).

By entering the Promotion, entrants agree to be bound by these Terms and Conditions.

No purchase is necessary to enter or win.  A purchase does not increase the chances of winning.

1    Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Terms and Conditions, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of the Promotor as final and binding as it relates to the content. The Promotion is subject to all applicable laws and regulations of England and Wales.

2.    All entrants must be aged 18 or over and residents of the UK.

3.    Promoter employees, respective affiliates, subsidiaries, suppliers and immediate family members of employees and / or those living in the same household of each are not eligible to participate in the Promotion. If any of the aforementioned are drawn, they will be disqualified, and a new winner will be selected.

4    To qualify, the entrant must fill in this form [link] with the Promoter between the dates of 9.00 am Tuesday 9 September 2025, and 10.00 pm Friday 7 December 2025. All applicable entries will automatically be entered into the draw.

5    Prize: One winner will receive £5,000 towards a touring holiday with the Promoter, chosen from the Best of Touring Autumn/Winter 2025 Direct Mailer. Offers in the brochure are subject to availability. If the offer chosen exceeds the value of £5,000, the winner will be responsible for paying the remaining cost and be responsible to pay the deposit in accordance with the standard terms and conditions of the tour operator with whom the winner will have a contract (the “Tour Operator”). If the holiday is less than £5,000 no cash alternative will be given for the remainder of the prize money, and no deposit is required. The winner will have until 6pm on 31 March 2026 to book.  The winner must comply with holiday destination entry regulations including visa and covid requirements. Travel insurance and expenses are not included in the prize and the winner is responsible for these elements. 

6.    The Promoter does not accept liability if the winner fails to redeem in accordance with these Terms and Conditions.  

7.    Specifics of the prize shall be solely determined by the Promoter.  No cash or other prize substitution permitted except at the sole discretion of the Promoter. Any and all prize related expenses, including without limitation any and all England and Wales laws and regulations and/or local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted. Acceptance of the prize constitutes permission for the Promoter to use the winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.  

8.     The Promoter acts as the agent for the Tour Operator whose standard terms and conditions apply. The winner will also be subjected to the Terms and Conditions within page 3 of Best of Touring Autumn 2025.   

9.     The winner of the Promotion will be selected in a random drawing under the supervision of the Promoter. The winner will be drawn no later than 7 January 2026 and will be notified via email or phone to the email address/phone number they entered the Promotion with within seven (7) days following the winner selection. The winner will need to go into any of the Promoter’s branches and will need to provide a valid ID in the form of a passport or driver’s license. The holiday must then be booked in any of the Promoter’s branches before the deadline date. The Promoter shall have no liability for a winner's failure to receive notices due to winners' spam, junk e-mail or other security settings or for winners' provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 7 days from the time the winner has been notified then another winner will be drawn taking their place.  

10.    The receipt by winner of the prize offered in this Promotion is conditional upon compliance with any and all England and Wales laws and regulations. Any violation of these official rules by any winner (at the Promoter’s sole discretion) will result in such winner's disqualification as winner of the Promotion and all privileges as winner will be immediately terminated.

10.    By entering this Promotion you understand that  the Promoter, anyone acting on behalf of  the Promoter, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the Promotion, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation. 

11.     The Promoter reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Promotion should (in its sole discretion) a virus, bugs, non-authorised human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Promotion.  The Promoter reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Promotion or website or violates these Terms and Conditions. 

12.    The Promoter has the right, in its sole discretion, to maintain the integrity of the Promotion, to void votes for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Promotion rules; or the use of bots, macros or scripts or other technical means for entering. 

13.    Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Promotion may be a violation of criminal and civil laws and should such an attempt be made, the Promoter reserves the right to seek damages from any such person to the fullest extent permitted by law. 

14.    Limitation of Liability: By entering you agree to release and hold harmless  the Promoter and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant's participation in the Promotion and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries. Nothing in this condition shall limit or exclude liability for death or personal injury as a result of the Promoter `s negligence or for any fraud or fraudulent misrepresentations committed by the Promoter

15.    Disputes: this Promotion is governed by the laws of England and Wales. As a condition of participating in this Promotion, entrant agrees that any and all disputes which cannot be resolved between the parties and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in the England and Wales having jurisdiction. Further, in any such dispute, under no circumstances will entrant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable legal fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Promotion), and participant further waives all rights to have damages multiplied or increased.

18.     If any of these terms and conditions is held to be invalid or unenforceable, the remainder of these terms and conditions shall remain valid and enforceable.
