Sticking clutch pedal section 75

I’ve a MK 7 fiesta ST clutch pedal been sticking to floor failing to return for over a year.

Took to garage told needed new clutch and flywheel went ahead at cost of £1580.

picked car up clutch pedal was down to floor, flicked it up and drove home new clutch felt lighter obviously newer.

Hour later garage rang me to say technician advised clutch pedal return spring faulty and likely needed replacing.

To my untrained eyes this seems to be original problem I took car in for so I’ve paid £1580 on unnecessary work.

what should I reasonably expect from garage to resolve this full/partial refund?

paid on credit card should I use section 75?

appreciate any advise thanks

Prove it.  (That will be your problem, the old parts will be in thew skip and probably gone)

You have had a new clutch, new flywheel and a new pedal spring.  The garage did the work and you are now the proud owner of these new parts.
The garage may give you a goodwill gesture but you have little hope of getting anything else.
A more competent garage would have tried the cheap solution first (the pedal spring) and only if this didn't fix the issue would they consider more complex operations.
I would find another garage to go to in future but I see no reason not to be confident about the jobs done on your car.
  • I don’t have a new pedal spring they phoned me after I’d picked up car to say the technician said I’d need one

Can you expand the above? Did you pre-authorise whatever needed spending, or did they do a diagnostic, then pause work and obtain permission to go ahead and replace those components (and at that time, did they estimate or quote the cost)?

The parts removed are YOUR property and you should be offered them following repair (unless some part is on the part exchange list) Most people say scrap them but people should be aware.

Re Clutch Pedal Spring - If there was history of it sticking I would have thought that would be the first part replaced before replacing clutch and flywheel

    I don't understand.

What did the garage say when you asked them why - if they were diagnosing a faulty return spring - did they advise you that you needed a new clutch and flywheel?

Did you not ask them to confirm the problem before doing any work?

It seems bizarre to me that after the new clutch and flywheel were fitted, and after you had picked up the car, they then rang you to tell that the problem was something different and that you'd probably spent £1580 for no reason!

Was there some failure of communication between you and the garage?  Or within the garage?

Was told to ‘see how I go’ regarding pedal returning as I’ve said apart from initially picking up car clutch pedal has been ok though in back of mind I’m waiting for it to stick.

On invoice it states investigate possible clutch failure.

Feel like I’ve taken care of in for a puncture garage has changed entire engine and sent me home still with puncture.

Ive emailed a complaint waiting to see there response before contacting credit card company

I feel ripped off with little knowledge of cars I trusted what garage told me, am I right to be upset and want something to put things right?

The clutch and pedal are two seperate items - Pedal failing does not mean the clutch fail - I have had the odd cable failure yet managed to get into gear and drive. I have had clutch failure and the pedal works fine.
Personally I suspect that this is lack of correct diagnosis
