    The professional advice is that DCB Legal will accept as low as a nominal £1 in full and final settlement (as this is their fault) BUT this is only relevant if the Defendant acts very promptly and emails the correct person at DCB Legal to do this well before the 30 days is up.

  • @Coupon-mad thanks for the reply above, sadly took me a little time to catch that response. We're 5 days away from the 30 days, however I've received the correct email for a contact within DCBLegal (thank you!).

    I've been looking through the previous threads and can see a few examples of set aside responses, which are extremely helpful and detailed - I was wondering if you know of any with example emails to DCBLegal. Fully understand we might be too far along within the 30 day period now unfortunately for that route.

    No. Stop reading irrelevant threads.

    Don't use a template.

    Do it NOW - explain that the claim was not served to your address & that the CCJ is clearly their fault, and make an offer of £35 to cover the court fee and resolve the matter but only if accepted, agreed and the CCJ removed this week and the claim marked as paid within the 30 days such that it is wiped from the register.

    Continue with this sentence:

    If DCB Legal do not do that this week, I will apply next week to set the wrongful CCJ aside with all costs falling to your Client to reimburse, given DCB Legal are at fault for the improper service.

    Oh dear. I did say this had to be done urgently.

    I literally wrote that reply with jet-lag the day after I flew back from holiday, to make sure you didn't delay. This why I said this and added the bold capitals: "The professional advice is that DCB Legal will accept as low as a nominal £1 in full and final settlement (as this is their fault) BUT this is only relevant if the Defendant acts very promptly."

    'Very promptly' is not 16 days later. You have lost the chance to start at £1. Now you will have to offer £35 with no time to discuss it.

    You were not advised to look through any other threads. You did not have time. I am so sad you didn't do this 2 or 3 weeks ago. Just email the person NOW.
