I understand the money is repayable but there are many who die without assets or money to repay it after a funeral is paid for. Which in my case was funded by the dwp due to lack if funds from my deceased sister and myself

I've been an executor twice and on both occasions I paid all outstanding monies which, on one of the estates, included returning an overpayment of pension to the DWP. It never occurred to me to keep the money as it was obvious that my aunt wasn't entitled to be paid a state pension after her death.
  • Sorry for your loss.

What if it was the other way round?  If your deceased relative was owed money would you be happy if the “debtor” took the view that the payee was dead so had no use for the money?

Of course you should pay it back.

As the letter from DWP didn't state the date of the overpayment I ignored it as I couldn't check if their assertion was correct. Over 20 years later, have heard nothing further from them
