IAS reversed decisions

2 PNCs were received for two consecutive days from UK CPM. After UK CPM rejected the 2 appeals, follow on peals were made to IAS. On the 29th day of waiting for the IAS adjudicator’s ruling, logged into the IAS portal to check. Upon checking, both appeals showed “Appeal Allowed,” with timestamps of 11:04 and 11:05, from what I recall. The decision stated something to the effect that the prima facie evidence did not demonstrate liability. It also had a paragraph something to the effect that the ‘the appellant should not take that decision was not based on what they wrote.’ I was over the moon to save or print the outcomes.

Fast forward the next day, day 30, I received emails indicating that the appeals had ben dismissed. On logging into the IAS portal, I discovered that both decisions had changed to “Appeal Dismissed,” and on opening each appeal, the decision was changed approximately 10 hours after the initial ruling.

Has anyone else had similar experiences and is there anyway of proving this?

    Send a SAR to the IAS asking for both versions of the decision. You need these and so do we! This sounds like someone told the Assessor to change the decision. This could be really important evidence that the IAS is as bent as we say it is.

    They should also SAR UKCPM for both outcomes and all emails in between.

  • After losing the IAS appeal, I continued to pursue the matter with the NHS Trust. As a result of my persistence, I'm pleased to announce that both PNC have now been cancelled.  :)

    After losing the IAS appeal, I continued to pursue the matter with the NHS Trust. As a result of my persistence, I'm pleased to announce that both PNC have now been cancelled.  :)
    I'm so pleased! Common sense prevails and you cost the PPC two IAS fees!
