Moriarty Law 30 Day Notice

Hi,

My partner has received a letter from Moriarty Law who have been instructed by JC International LLC to recover a debt relating to an agreement with First Central Management Ltd from Oct 2019. She's never been in debt and has no idea what this could be in relation to.

There's been no previous contact. Advice would be greatly appreciated.

    Letter when you know nothing about about the debt - AKA "Prove it" letter — MoneySavingExpert Forum

    Send it by snail mail, get free proof of posting from Post Office.

    "30 day notice", can you say exactly what this says or post a screenshot of it (put something over your name and address so they dont show)? 

    If this is a Letter Before Action, then replying with a Prove It letter is not a good idea, you need to use the attached Reply Form to dispute the debt.

    Has she checked her credit file?  JC International reports to both Experian and Transunion so there should be something showing. 

    But this sounds like a desperate last gasp attempt at getting something admitted to before the 6 years statute of limitations is up.  I would be good to see a copy of the letter for clarity.

    What`s this "30 day notice" you mention?

    As per the posts above, you need to clarify what they have sent you first, before issuing a response.

    It does come with a reply form stating that it could result in court proceedings if it's not completed.

    OK There are no forms from an actual court?

    It looks to me to be a threatogram trying to get you to think it is an actual letter before action.

    Add what does the attached form ask for?

    I may be wrong on this but what they have said seems a bit wooly to me

    It's definitely their own form, split out in the below sections:
    1. Do you owe the debt?
    2. How will you pay?
    3. Do you intend to get, or are you already getting, debt advice?
    4. What documents are you sending with the form? What information do you need?
    Later on it states: "If the business does not get your reply form within 30 days, it could take you to court in relation to the debt.

    Just as an update: there's nothing showing on her credit report in relation to any debt.
