Power Reserved

Hi, I am currently completing probate online.

There are 3 executors. One of them lives in Greece and does not want anything to do with the process although he does want his part of the inheritance which is split equally 3 ways.

It is very difficult to contact him and we have no idea about his address.

On the probate I can tick Power Reserved so he can apply later although in reality he never will.

Does this make any difference to him and will he still receive his equal share?

(The inheritance is only cash as the house has been sold)

thank you

if they are a beneficiary then they get what they are entitled to, not taking an active role as an executor does not alter this.

You have said "There are 3 executors. One of them lives in Greece and does not want anything to do with the process although he does want his part of the inheritance which is split equally 3 ways.

So how do you know he doesn't want to act?

@NorthYorkie He told my wife he doesn’t want anything to do with his father and doesn’t want to know about anything. Its a difficult situation but if I put Power Reserved rather than Renunciation then he gets to apply later if he wants.

Once the two other executors have applied and receive their certificates I am unsure why he would apply later as the money will have been split by that point

Thank you - all done and the other executor has also Power Reserved so that leaves my wife as the remaining executor. Wife asked them via WhatsApp and put in a link to the meaning. Both said for her to carry on

Have sent them the documentation as well (downloaded pdf).

    thanks

OK, but if you don't know his address or contact details, how are the executors going to be able to distribute his share of the estate when the time comes?
