I agree - but the documents state arrival time 14:00 - departure time 17:59.Anchovie said:
Er, I didn't (I'm not the driver) but I'm familiar with the site and have to agree that I'd struggle to spend 4 minutes there....LightFlare said:Just out of curiosity- how did you manage to spend 4 hours there
So your vehicle spent 4 hours there - was just curious as to how anyone could spend that long there (unless they worked there i guess)0 -

I have a letter headed NTD addressed to me. I am the Legal owner but a finance company is the registered keeper. I was not the driver.Smart got my name from finance company:

That's a weird hybrid document! But to pull it away from the finance company I would appeal it without confirming whether you were the driver or not. Send something vague such as:Anchovie said:page 2 of Smart NTD
'My appeal is that I believe the signs were not prominent and am not convinced that the car stayed for 4 hours. Check for orphan images.'
That SHOULD hook the rejection to you and away from the finance company. Then you can lead them on the merry dance of the IAS to collect evidence for this thread:

You will likely 'lose' at the IAS. That's nothing to worry about. Just don't cave in and pay!

Hi,
smart parking have issued me a NTK. In the presumed date of delivery they have stated it is 2 working days from the date of issue. Which according to law is from the date of postage and that they should retain evidence of postage. As their notice is incorrectly worded should their notice be deemed as invalid? Sorry, can’t upload a pic as I’m a newbie0 -
Gav , I answered you in your new thread1

Ok, I've had the letter from Smart rejecting my appeal and offering a IAS appeal. I registered with IAS but cannot proceed further as I am the owner (not the keeper or Driver):

So I've emailed Smart to advise them of this (without confirming I'm the owner) and asking how I appeal or to cancel their invoice.0 -
Who is the Registered Keeper - as shown on V5C (logbook)? In whose name was the NtK?Anchovie said:Ok, I've had the letter from Smart rejecting my appeal and offering a IAS appeal. I registered with IAS but cannot proceed further as I am the owner (not the keeper or Driver):

I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Registered keeper is a finance company. Didn't get a NTK. Only a NTD as above (added 3 September).0

This is great news because when they hand the data to DCB Legal to sue you, as owner you can't be held liable.
Let it happen. Forget IAS. Easy peasy!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
