Smart Parking DCB Legal Civil Court Claim

Hello, I have been reading messages on how to respond to these but wanted to ask advice on my claim just to make sure it's not different to others, and if not, I'll delete the post to avoid duplication. 

I have moved address but have been sent a court summons due to ignoring a parking fine from Smart Parking, then chased by DCB Legal. I had over stayed in a train station parking when being dropped off for work due to a mental health condition. This worsened during this time and I have various professional notes and proof of my issues would they be required. 

The claim relates to January '22, so honestly, I cannot remember how long I overstayed and I'll admit I ignored the letters that came through over the initial period. They have tracked me to a new address and I now do not own the car, although I did then and was the driver. 

Would the defences in the other threads still be applicable for me to go back to the court with?

    If it's a railway car park then POPLA does not apply, and therefore the keeper ( you ) cannot be held liable for the actions of the driver ( whoever they were ;) - get my drift ).

    Respond as per the newbies thread in that manner.

    DCBL may ignore your appeal, but will fold before it get to court anyway - so no worries.

    You definitely do not have a summons,  just a money claim from the CNBC in Northampton using MCOL 
    Post the Issue date from the claim form below and also post a redacted picture of the POC from the lower left of the claim form below after hiding the VRM details first  ( no personal or private details allowed on mse  )

    There was no fine,  just an invoice from Smart parking 

    Ownership is irrelevant,  it was your vehicle at the time 

    Yes you use the typical Smart Parking DCB Legal version of the template defence by coupon mad

    We are counting those as evidence for the government.

    You do not have a court summons. You just have a Claim Form and yes your case is the same as all the other Smart defences that include the words signatory misled POFA.

  • Thank you for the quick reply, I've had a court summons, so presume I respond to the court directly with my defence that I can get from the newbies thread. There is no point in appealing to DCBL now is there? Or is that worth doing too?

    Frankly,  we dont want or need to see DCBL or DRP or ZZPS etc powerless debt collectors letters,  as explained in the 4th post in the newbies sticky thread in announcements near the top of the forum 

    The important letters are a Letter of Claim,  usually from a legal company or solicitor such as DCB LEGAL,  Moorside Legal, B W Legal,  Gladstones Solicitors etc 

    And the properly redacted N1SDT Claim form sent via Money Claim On Line from the CNBC in Northampton,  the one you posted ( which is definitely not a summons   )

    Follow the advice above,  starting with completing the AOS online stage first
