Burglar Alarm on selling house - Scottish law

    Scottish Standard Clause 4.1 would include the burglar alarm so you’d need to exclude it (unless you mean you’ve already excluded everything apart from the central heating).

    As it’s been disconnected from the electricity and back up battery, I know it’s not working.

    My question was whether or not I need to get it reconnected.

    Yes I will be speaking to the solicitor.

    I would say it’s a “system of a working nature”, yes.
    Although not of a working nature when house was marketed or viewed but yes I take your point. One for the solicitor to deal with.

    I think it’s implied that it means “systems which at one point were meant to work”, otherwise the clause is a bit pointless!

    How much work would it be to remove if it's already disconnected? If it's easy to get rid of it I'd do that, otherwise describe it as disconnected in the paperwork.

    You would still have to vary the contract to say that it isn’t included at all, as otherwise it’s one of the things included by default if it was there at viewing.

     Not everyone wants to have a burglar alarm.  I would not spend money on doing anything with it, just say it has been disconnected , you could even state why.

       The new owners can have it reconnected if they wish.

    Ask your solicitor to bring that fact to the buyer’s  attention.
