Leasehold flat

I own a leasehold flat. The freeholder passed away 6months ago. No one has applied for probate.my lease states freeholder is responsible for house insurance which has run out and not been renewed. all communication with daughter has been jgnored what can I do as without probate I cannot sell my flat.

    Do you know the daughter is the executor? Could be somebody else responsible.

    Can you please explain a bit more about your setup there?
    I own a leasehold flat in a purpose-built block.  The freehold is owned by a law firm.  The management is handled by a RTM company of which some leaseholders are directors.  The RTM company appoint a managing agent to perform the duties required under the lease.
    For me, the Freeholders takes a small annual ground rent payment but the service charge payable to the management company covers the buildings insurance.

    How many flats are there? Is the freehold in the name of the person or did they have it under a company? As above, who is the executor? 

    You should point out that lack of insurance could be VERY costly to whoever inherits the freehold should anything go wrong. If the flat/s are mortgaged you could also speak to the lenders as they will want the asset protected.
