The only plan i would follow is plan A in an OPS case, because I am willing to let a judge decide if it got that far
As for your case, it's trespassing on private property ( you said it was a public car park, but clearly not a public car park, but a private car park ) , you were unable to comply with the signage, so could not accept the offer because it doesn't tell you how to get an e permit
You were focused on the lack of bays, instead of the written allegation of unauthorised parking
So a court case would focus on the signage, the CRA 2015 , no landowner authority, no parking contract on offer to the public, no indication of how to comply with the signage, as well as poor bay markings, but the lack of bay markings is a side issue3 -
Arguably you could get an e-permit or a P&D ticket - this is expressed in the alternative, but everyone has to park in a marked bay (the emphasis should be on the and, not the words parked bay).
If you can't park in a marked bay, there is an argument that the contract was impossible to perform.
Obviously noone on here can determine if a judge would go for that. Its possible they could, but the claimant is unlikely to concede that. Worth checking if the claimant PPC contracted with the site owner to display signs and to mark bays etc.2 -
I can only see a knackered old sign in that photo, and nothing near where the car is parked2
