Hi all,
I'll try to keep it short and sweet. I put in the wrong reg at a carpark (I believe its only one character out), received a NTK within the 14 days time period. I appealed, mentioning a keying error and the parking company rejected the appeal.
Ready to appeal to POPLA now. Would like to know if this NTK is POFA compliant and if not why, also one thing I find bizarre is in their rejection letter they state they a have found a similar VRM so essentially admitting a keying error??
I'd also argue they don't have a strict proof of a chain of contracts allowing them to operate legally.
May I please have a template for POPLA please!
So my appeal would be:
1) its a minor keying error and at most a major keying error.
2) Possibly non-compliant POFA NTK (unsure)
3) Provide a chain of contacts from the landowner proving they can operate.
I've attached the rejection letter and NTK below:

Was the driver outed in the initial appeal ? If yes then bin Pofa2012 arguments, regardless of any compliance or not ( no Pofa warnings on that NTK PCN letter, despite it being issued promptly ))
Seems to me that they should have cancelled for a minor keying error or offered the £20 option for a major keying error, but did neither4 -
Yep if they failed to properly handle the keying error - DESPITE ADMITTING IN WRITING THAT THEY'D FOUND AND MATCHED THE PAYMENT MADE TO A SIMILAR VRM* - and they failed to either cancel the PCN (minor error) or offer to settle at £20 (major error) than you win at POPLA even if you outed yourself as the driver. Secondly, I see no mandatory Entrance Sign facing you at that 'IN' roadway. That's another clear breach of the Code of Practice.* their conduct is a misleading action under the DMCC Act and you could complain to the Competition and Markets Authority, who enforce that law as a regulator with actual clout.
The CMA has new powers this Summer to fine traders for lying or omitting information and misleading people by not complying with a Code of Practice they say they adhere to. This is a civil offence by the parking operator. Report them.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I wonder if they had high disciplinary sanctions. I wonder if those sanctions transfer across if an operator jumps ship?
I don't think the MHCLG sanctions plans state that this must be the case if an operator forum shops and hops to the other Trade Body when they already have sanction points.

Thank you all very much for your prompt replies! I cannot remember if I stupidly outed myself or not but I go with the entrance sign breach and obviously the keying error. Yes they were a member of the IPC which I found strange. New kids on the block?

Yes, you have to lead POPLA by the hand some are not the brightest sparks, and they also fall on the side of their paymasters at any excuse.5 -
