Hi all,
I had my mediation call today. I was offered a settlement of £220 and then a further reduced settlement of £170, which I politely declined
I briefly outlined my defence to the mediator. I Park Services responded by trying to brush off the fact that the NTK is not POFA compliant - something along the lines of they don't need to specify a period of parking - I can't remember the exact wording the mediator used - something along the lines that the photo is a snapshot, showing the contravention took place ie the period of parking is not the issue, the fact that parking took place without a permit is - so a trespass issue rather than a parking issue.
They ignored my complaint that the Terms and Conditions are unfair.
They also said that the site is private property so they are allowed to film on the site - completely ignoring the point I made to the mediator that the camera is capturing data on public property, ie London Road.
They also completely ignored my points raised relating to the inadequate signage and no additional signage for the material change of use of the site from parking to restricted parking.
As expected, a complete waste of time but a necessary step on the road to discontinuation
