I Park Services Court Claim via DCB Legal - Advice needed

Looks good. It's an unusual one.
And if you haven't done the Public Consultation yet, the deadline has been slightly extended. See this thread:We understand that you may need some pointers. It looks laborious but no knowledge is needed except re your own experiences so you can call out a scam industry and you'll protect millions of motorists and help change the law.
I've written some guidance to help focus new posters on the issues. I've covered almost every question, providing ideas if you agree with our stance on things like DRFs, which we say must be banned.
Ordinary people like you are falling victim to this scam 15 million times per annum. Motorists need your voice added please.
CLOSES ON FRIDAY 26th SEPTEMBER.

You should definitely do a counter claim BUT you must do it the same time as you log your defence.2

Some useful dates for you, 20th September is a Saturday and no deadline will be for a week-end: -Sprockerdile said:Any feedback would be welcome, I need to submit my defence by this Friday, as I am away then until 20th September, which is my deadline.Issue Date Served Date AoS Due Defence Due 18/08/25 23/08/25 06/09/25 22/09/25 3 -
Hi all,
I had my mediation call today. I was offered a settlement of £220 and then a further reduced settlement of £170, which I politely declined
I briefly outlined my defence to the mediator. I Park Services responded by trying to brush off the fact that the NTK is not POFA compliant - something along the lines of they don't need to specify a period of parking - I can't remember the exact wording the mediator used - something along the lines that the photo is a snapshot, showing the contravention took place ie the period of parking is not the issue, the fact that parking took place without a permit is - so a trespass issue rather than a parking issue.
They ignored my complaint that the Terms and Conditions are unfair.
They also said that the site is private property so they are allowed to film on the site - completely ignoring the point I made to the mediator that the camera is capturing data on public property, ie London Road.
They also completely ignored my points raised relating to the inadequate signage and no additional signage for the material change of use of the site from parking to restricted parking.
As expected, a complete waste of time but a necessary step on the road to discontinuation

"a trespass issue rather than a parking issue."Hmmm... yet they didn't plead the claim under the tort of trespass!

Evening all 😊
So tomorrow was the deadline for submitting my Witness Statement and relevant documentation, so I posted a hard copy to the court on Saturday and then emailed DCB Legal the same last night (after checking they would be happy to receive it by email).
Then today, surprise, surprise, I have received confirmation from DCB Legal that I Park Services have instructed them to discontinue Court proceedings 😂🤣 - see below
I can't quite remember how the song goes…something about Another one bites…😁
Thank you all for the advice provided, especially @Coupon-mad.
Feel free to add me to the list of DCB Legal Discontinuations.

Yay - congrats! 😃
New statutory Code of Practice to be laid before Parliament this Autumn. Keep your eye out because I've tried hard on the MHCLG Steering Group to get the false double recovery fee banned once and for all.
ANOTHER ONE BITES THE DUST!

Thank you @Sprockerdile for the copy of your NoD . I can now get this counted in the DCBL Legal thread of shame. 👍
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
