PoFA says NTK must specify date on which the notice is sent" but NTK says just 'Date' - is it legal?

The PoFA 2012 Act says (section 4, 9(2)(i)) a NTK must "specify the date on which the notice is sent (where it is sent by post)". 

My postal NTK from UKPC has a Parking Charge Date (when the "offence" was committed), a Date, and (on the tear-off payment slip) a Parking Charge Issue Date. Do any of these fulfill the Act's requirement?

(My POPLA appeal was rejected; the NTK Date and the Parking Charge Issue Date are both the last possible date for the NTK to be delivered in the statutory time according to the Act - the NTK was actually delivered 2 days after the statutory time, but (of course) I can't prove delivery date, so I wondered if the NTK not explicitly specifying the date that the notice was sent would be sufficient for the charge to be dismissed if it came to court.)

    I suspect "issue(d)" would be regarded as having the same meaning as "sent".
  • Yep, and therefore they wouldn't have to prove the date it was sent, even though I'd have to prove the date it was received.

    I guess it's the same as the Act requiring a period of parking to be specified, and just a single time would be regarded as a (1-second) period.  

    Looks like I'd better pay them rather than risk the chance of being fined more by a court in years to come.

    Woah. Don't pay the clowns.

    UKPC do make court claims sometimes, but usually through DCB Legal who discontinue the claim.

    Just ignore and defend any court claim. 
  • I'd prefer not to pay them (!!) but if "issued" = "sent" and I can't prove that the NTK arrived late then I don't really see that I have any viable defense.

    Whaaaat? Stop! You don't PAY just because you lose at POPLA!

    Have you missed the fact that nobody pays UKPC and nobody loses? All 'single PCN' DCB Legal/UKPC claims are discontinued. You could literally put in a nursery rhyme in para 3 of the Template Defence and you'd still see the case discontinued with no hearing.

    Costs you NOTHING to defend a claim.

    You will never pay a penny.

    There wont be a summons,  it's a civil matter 

    File away any powerless debt collectors letters or texts , ignore the phone calls

    Respond to any future Letter of Claim giving you 30 days notice , it would come in the post

    Get our advice for any possible future N1SDT court claim pack from the CNBC in Northampton using MCOL,  a civil court claim pack of documents, that arrives in the post, so paperwork

    What 'summons'? There is no summons! It's only small claims. Tell them if you move house but that's obvious common sense, not parking related.

    More urgent: A reminder this month to do the government's Public Consultation if you haven't done it yet.

    Their proposals are wrong. We must stop them.

  • Gr1pr - I used "summons" as a general term, maybe should have said "claim", my bad. I don't give out a phone number, so if they phone me, that's a Data Protection issue.

    Coupon-mad - that's a fair bit of reading for the consultation. Will go through it over the bank holiday.
