Probate Needed?

Hi, my Dad passed away in 2021 and left his half of the house in trust. This is to be split between various family members on my mothers passing. Should we have gone through probate? All other monies were in joint names with my mum.

    Were your mother and father joint tenants of the house? or tenants in common?

    As important, has the trust been registered with HMRC, or you'll face fines.

    Assuming that they were tenants in common ( the bequest would have failed otherwise) there was no need to apply for probate to deal with the transfer of his share of the house to the trust. If the trust has not been registered with HMRC that should be sorted ASAP.
