    Your rights are what you can enforce through court, there is nothing to stop two parties agreeing a different solution to what the statuary rights are. Have personally done so many a time.

    The issue here is the OP asked to return it for refund/exchange and the merchant said no, the OP has suggested a middle ground of return for a voucher but the merchant has still said no.

    Personally would probably just try the returns process anyway given its all self service online and doesnt require their prior approval to return. The fact you have detagged it doesnt help but ultimately this is a return for them being faulty not a change of mind. 

    Who "has the problem" will depend on the terms between the merchant and their supplier but thats nothing to do with you.

    What sort of mark is it?

    Is it in the same position on the back and the front ?

    Could it have happened when it was  hanging up?
