I called the court to see if the claimant have paid the court fees which was due by 22nd May and they have not, so this means the case is struck out if I’m not mistaken. If so when should I receive an email or letter as the case is supposed to be in 10 days.

Email DCB LEGAL using their info@ email address and demand a copy of their N279 discontinuation document by return within 7 days or you will claim wasted costs

I haven’t received any response from DCB Legal yet and neither anything from the court informing me about the case has been thrown out, so what should I do as the hearing is suppose to be on Friday and I haven’t booked a day of work and don’t want to waste one either just to be told there’s no case.

Just called them and they said it’s not struck out because the claimant claim they did not reaceavebthe summons letter, so now they have been given it theywill need to pay by Friday to proceed. So does means they are still proceeding ? Otherwise why would they even contact the court.

Follow up your last email to DCB Legal NOW and tell them what the court said and that the hearing is going ahead (without witness statements) and you will attend and claim full costs if they fail to email over a Notice of Discontinuance by Wednesday.

Good news the case has been struck out as the claimant has not paid fees. Do I make a claim for costs like time spent preparing the case or is it not worth the bother?

You could try sending the court an email for costs like the ones linked in post 2 of the NEWBIES thread (the bit about this stage & costs). Up to you.
