Dreaded "credit hire car" non fault accident & court

    Saying that part of the money in your son's bank account is yours, makes it sound like money laundering!


    Unless there is documentary evidence that there is money that is rightfully yours in your son's account then you actually only have £1000 in savings
    If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales

     You had an accident. Did your insurance include a FREE courtesy car whilst being repaired? If so what is the problem? 

    Are you claiming as an uninsured loss as you needed a vehicle whilst yours was off the road and you are claiming against a third party?

    86 days at a cost of £6500 (£75 per day) sounds a long time and expensive - What car was being repaired and why so long - What was the hire car?

    Trinity ARE a claims mangement company - Were you informed of the possible costs at the start?

    It's my bank account, I set up a savings account for my son with his money in it. I then transferred a few thousand from my account a few years back as the interest it gains monthly is good (more money in, the higher the interest paid) and just keep a float in my current account for bills, everyday spending etc.

    So when I get paid weekly I normally transfer into the savings account and record how much is mine and his. He's 4 years old lol

    You obviously will know (or can calculate) how much of your money is in son's account, but you will have to add this to your standalone £1000 and if the figure is over £6500, then yes you could have technically afforded the hire car

    Your sons savings account may not legally be available to you. Together with my son we are looking at investment opportunities - His daughter and my Granddaughter has justhad a baby and we are looking at setting up an account for her future - The money will be for her and her parents may hace access to the money for the childs benefit - Should your sons acount be set up as we are considering then you could not legally access it.
    Sorry to be longwinded but that money is not yours to use.
    These Claims handlers are ripping people off. A Nissan Juke on a long term hire would not cost £75 per day.

    If the account is set up in your son’s name with you as trustee then the money is his in maw and you can only use it for CV his benefit.

    Also, any interest over £109 is considered yours by HMRC, and you  may be  liable to pay tax on it depending on your income and any other interest you receive. 
    You need to keep your savings in an account in your own name.

    If the account is in your name, it's your money.
    If the account is in his name, it's his money.

    Have you spoken to your insurance company? This is something they should be dealing with. Even if you could afford it is not something you should be paying for out of your own pocket for a non fault accident.

    What really surprises me is why a fairly low value car with structural damage was not written off.

    Yes but I have to comply with their solicitors request and respond to any letters. I'm just worried that the bill is going to land at my feet
