Parking charge from PCS - no images (SUCCESS)

    Could you kindly cast your eye on this before I submit to POPLA please:

    This letter (Attachment PCS Letter) is a vague template. This should have included a close-up photograph of the sign they contended was at the location on the material date, as well as their images and videos of the vehicle. They did not submit any photos with the letter. The link on their website can’t display either the signs or the videos. Please see attachment PCN 1 and PCS website photo which prove there's no evidence. How can a Parking Charge Notice be even issued without the images/videos? That's a ground for rejection I think.
    Also, this letter (attachment PCS letter) wasn’t served within 14 days as is the requirement. I received it on 16th August, which is well outside the 14-days time window. Plus, they never issued a Notice to Keeper, again a reason for rejection.
    Finally, they have omitted the POFA para 9 requirement about 'pass this notice to them' if naming the driver

    A PCN by post is a NTK. Same thing.

  • Thanks for your feedback. Other than that, is the rationale OK? Do you think there are enough grounds for cancelling the PCN?

    No it won't be cancelled! I thought that was made clear in the NEWBIES FAQS thread? Appeals don't see private PCNs cancelled and aren't designed to. Nobody pays these.

    The operator has contacted us and told us that they have withdrawn your appeal.

    If you have already paid your parking charge, this is the reason your appeal will have been withdrawn. Unfortunately, you cannot pay your parking charge and appeal, which means that POPLA’s involvement in your appeal has ended. You will not be able to request a refund of the amount paid in order to resubmit your appeal to us.

    If you have not paid your parking charge, the operator has reviewed your appeal and chosen to cancel the parking charge. As the operator has withdrawn your appeal, POPLA’s involvement has now ended and you do not need to take any further action.
