Ongoing CCJ Battle with ParkingEye – Now Hit with More Fines
Hi everyone,
I’m currently in the middle of a long-running dispute with ParkingEye which has resulted in a CCJ against me. I have a mediation call scheduled for next month to try to resolve it.
In my defence, I stated that I never received any of their original letters regarding the alleged contravention. I’ve repeatedly asked ParkingEye’s legal team for evidence (and did so in my original defence) but have yet to receive anything substantial from them. I believe I have a strong case based on the lack of correspondence and proof. I haven’t personally driven in the past two years. I work from home and, on the rare occasion I need a car, I’ve just day-insured my own vehicle (which has since been written off after being hit by an uninsured driver). Before anyone asks, I do let my family members use my car.
Now, out of nowhere, I’ve just received a letter from a debt collection company acting for the same company (ParkingEye Ltd) demanding payment for another 3 fines. Each is £70, plus a £70 “fee” per fine – so £420 in total – on top of the £250 they’re already chasing in relation to the CCJ.
I’m unsure how best to approach this new set of demands while my CCJ case is ongoing.

Can they pursue me for new alleged fines while there’s still an unresolved court matter with them?

Is there a way to challenge these new ones immediately before they escalate to the same point as the CCJ?

Should I bring these up during mediation or deal with them entirely separately?
Any advice from those who have dealt with ParkingEye or multiple claims like this would be really appreciated.

As DCB Limited are involved it's more than likely that PE have all but given up on this, but just hoping that DCB can give you a final squeeze to see what might drop for them. This will progress to DCB Legal but, as long as you go through the process, they will discontinue. See the following thread, read the first handful of posts to get the gist, then seek out the PE cases there (probably more likely to find them from the past 12 months rather than the first 2 years of the thread's existence).somerandomuser22 said:

Doesn't sound like you have an ongoing CCJ case
I think you have an ongoing court claim from Parking Eye, possibly via DCB Legal, with the mediation stage next
Not a CCJ , unless there has been a court hearing and a Judgment
There are no fines, just invoices4 -
Show us what you have for this CCJ (or claim form?). I think Mediation isn't offered for applications to set aside CCJs so it doesn't sound like you have a CCJ.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Parking Eye certainly would not do this.1 -
More often than not, the common theme of private parking charge notices not being received is V5C (logbooks) not being up to date with current address. As above, check that your V5C is up to date and correctPlus Parking eye do not issue fines.You said you have a CCJ, if so in what court was this issued?, this happens when they take you to court, you lose the court case and then dont pay.Unless you have everything in a horrendous mess and you dont quite know what you are dealing with, as you have called these things "Fines" there is a good chance that you are getting confused and as a result you may be making things harder, ( but not impossible) to deal with.First things first, for now do not attempt to identify as to who could have been driving.Where were the parking charge notices issued - ie name of car park and location and why, for example5 Parking charge notices were issued to my vehicle in Morrisons car park, somewhere town, postcode AB12 3CD after a passenger was dropped off and picked up at the start and end of their shift stating my vehicle was in the car park for 8 1/2 hours each dayFrom the Plain Language Commission:
