PCS acting for AM Parking £120 Notice to Keeper

    I've decided to escalate. Regarding the £120 Notice to Keeper (and I've seen a lot of these from various parties) who is culpable AM Parking or PCS (DC Plus)? AM Parking is very clearly the data controller as per their ICO registration and privacy policy, but the NTK has been send from PCS.
    The misleading action is by PCS (aka Debt Recovery Plus) and they can be reported to the BPA and the CMA.

    As I said:

    - it is in breach of the DMCC Act because they claim to be operating under the Code of Practice. That's untrue and in consumer law that's a 'misleading omission' which is a proper offence!

    No this one is cut & dried: in breach of the CoP and in breach of the POFA, too (exceeds the 'maximum sum' rule explained in Explanatory Note 221).

Despite having sent a comprehensive appeal and in spite of that appeal still not being concluded the keeper is now being chased for the perceived debt by PCS.  You'd think in view of everything they'd want to keep their heads down. A recent SAR also reveals that no appeal has been processed at all, or details are being withheld.

    Does anyone know a contact in the BPA that the keeper can cc when next they e-mail PCS?

    It'd be fun to let it go to court to then demonstrate they are breaking the law.

    You can't do it that way. You must lodge and exhaust a complaint with the PPC first.
