Selling on Viagogo help

Essentially I've messed up. I excitedly bought two tickets off someone on Facebook for above face value. I used goods and services PayPal so if she didn't send the tickets when they are available for transfer I could get a refund.

Anyway, I then told my girlfriend about the tickets who went crazy as we're due to give birth 3 weeks later so as I don't physically have the tickets I can't relist officially and as they were above face value I decided to list on viagogo.

I put them on Viagogo way less than other tickets as I just wanted to make my money back so they sold instantly! Now I've realised I'm in a bigger problem.

If this lady doesn't forward me the tickets, I am legally obliged to fulfil my order with Viagogo. Penalty can be 100% on the ticket price or the cost of finding an alternative (this would be loads). So now I'm thinking I could end up losing a load of money! 

What I don't understand is that Viagogo have already taken this persons payments and hold the money. Why would then refund him that and then fine me for 100% of the ticket money. Has anyone had experience with this?

I notified them within 48 hours as per 2.9 in their terms of sale but apparently this means nothing.

    Can you provide a link to the terms of sale you're referring to? Clause 2.9 must mean something because it is in the T&Cs, but whether it applies to your current situation depends without seeing the terms of sale you're relying on.

    Thanks for the reply. My only out I guess is that they auto confirmed my sale so it was binding however my tickets were not going via viagogo and were directly  to buyer so they shouldn't have autoconfimed. I've been on the phone to them for hours. Their TOS is extremely contradictive.

    I bought  them off someone on Facebook. My issue wasn't  too much with that sale initially as it was goods and services and I had every intention of using the ticket! My girlfriend then wasn't so happy so I listed on viagogo. Unfortunately I listed them so much lower on viagogo so they sold instantly! Now I'm in this contract that looks like it could be very very costly if my initial seller decides she gets a better offer closer to the gig or if she decides she wants to go!

    Just clarifying as that means  Viagogo  are not involved with selling of the tickets to the OP. 

    So, there will be no confirmation etc. that the OP is referring to. 

    He appears to have sold tickets he does not have, may not get, may not exist.

    When exactly is this event? Is there a risk your PP payment expires chance of claiming non receipt before the event even occurs?

    Ultimately this could indeed prove expensive, as you've fundamentally sold something you don't have.

    The event is September 27th. So I believe my PP was fine. Like I said, my error here is then using viagogo as the middle man. I should have just tried to resell them privately. Issue is as I'm not currently in handle of the tickets (as transfer isn't available yet) nobody would take me seriously. The events in such demand that I should have waited it out and they would have sold regardless.

    I've just rushed for a quick fix and didn't realise how terrible the terms of service for Viagogo are!

    Oasis tickets, I assume. 

    You need to be very careful about what you have signed up to. Viagogo are not known for their winning customer service.

    Yep! I'm gutted because I bought the tickets buzzing that I could go. For context I've already been twice. My girlfriend was not so happy I'd decided to get tickets again. 

    But listing them on viagogo seemed a good idea as I don't physically have the tickets yet. I cannot believe how mental their policy is. I listed them for £400 each (what I paid off someone) and they sold instantly as all the others are like £1000. What I didn't realise is that if this sale falls through, Viagogo can release the funds back to the buyer they are holding   AND charge me £800. They can also charge for a replacement ticket.

    I tried  to cancel within 24 hours of the sale as soon as I realised this but apparently I can't. Their T&Cs have so many flaws as they automatically confirmed my sale when their terms say they should only do this if they are handling the tickets (there not) and that if I didn't confirm I could report an issue within 48 hours.

    Overall I am a little screwed. In hindsight I should have just kept the tickets, waited for them to land in my account and then done a private sale OR filed for a refund with PayPal if they didn't come.

    I would never ever use Viagogo again. It's set up for the bit tours who are selling multiple tickets and can take the mental fine if all the other sales they've  listed get through.  It is not designed for one off ticket sales!
