Faulty EyeParking machine at Asda Rugby

 I’ve checked all discussions re parkingeye/asda/faulty machines, but none of those seemed to match my situation, I believe.

 In December 2024 I parked at Asda Rugby and overstayed the courtesy 2hrs meaning I had to pay £2 for a stay up to 3hrs. I was heavily pregnant at the time and almost left the site without paying, but last minute I parked in a bay before the exit and run to the machine. I left my under 4s in the car as I hoped to have the car in my eyesight when making a payment. The machine failed to take my payment on first occasion and on the second the screen kind of froze in “processing payment” (it was a contactless payment) so I decided to run back to my car worried that I left my child in there (pregnant brain- please no judgment).
 In January 2025 I received the 1st letter from Parking Eye asking me to pay the fine, to which my husband (the registered car owner) replied that it was me (his wife) driving the car and that machine was faulty. ParkingEye of course rejected that appeal and since then they have been chasing me to pay £100. I sent to them “final appeal” via their online appeal process describing my mental and physical state at the time, but sadly I have no photographic evidence of the machine’s failure. I then received an automated response that I had time to appeal to POPLA, (which I didn’t because with newborn at home and other child at home that situation slipped my mind), and they of course, rejected my final appeal.
Recently, I received the letter from DCB Ltd titled “notice of debt recovery” where they ask me to pay £170 within 14 days of receiving the letter or  the matter may be taken to Court.
Can anyone advise me what are my options here,please?
 I’m on SMP and I simply cannot afford to pay that amount.

    Well you'll never pay. Don't worry but tell your husband not to ignore the DCB Legal letter or the Claim Form but that it's EASY to defend and win. No CCJ or costs are risked.

    Obviously you can ignore DCB Ltd!
