ESA to UC migration and SDP

I am hoping some one may help and that I have my interpretation of the SDP correct?

So sister has migration letter, I have set up UC account and have an appointment as I need to change appointee to myself.(mum currently appointee). Lovely lady at DWP advised for me to be appointee as mum elderly and no Internet etc.

Anyway, I generally have a good understanding of the benefit system(previously worked in benefits) but I want to make sure my understanding of the SDP is correct.

Sister is in receipt of ESA (ib) and is in support group. Also receives DLA high care and high mobility.

She does not receive SDP as lives with parents.

No-one receives Carers allowance, mum has carer entitlement as she receives state  pension but does not receive payment.

However this is were I would like some clarification on the SDP as 'entitled to' says should be receiving the SDP as both parents are in receipt of AA.

I only came across this due to the UC migration as I want to roughly know what she will receive each month.

If it is correct should my sister be receiving the SDP from when mum starting receiving AA?(dad was already receiving before her award).

And can I claim a backdate of any SDP sister has missed out on?

Any help appreciated and apologies if long winded.

    SDP isn't "claimed" as such it should be automatically paid when a person becomes entitled. The DWP doesn't always know when entitlement starts hence it's not always paid.
    The SDP payment should be backdate to first day of entitlement, currently the SDP is £82.90 per week.
    Is you sister getting Enhanced Disability Premium?

    I as far as I am aware she does not receive the Enhanced Disability Premium, I can check this tomorrow.
    I presume she can only receive either the Severe or Enhanced from my reading?

    I know it's not claimed(I am retired but always go into benefit mode lol)and I would need to request a backdate and state the reason why it's not been claimed. Mum starting receiving AA in April 2024.

    A person can get SDP & EDP (also called for ESA Disability Income Guarantee)

    You want to make sure they backdated from start of entitlement, you do not have to state a reason it wasn't claimed as it's not being "claimed"

    Contact the DWP and state they are not paying the premiums like they should be (they might want more info) and inform them to make sure it's all payments are backdated

    Do Mum (& Dad) receive Pension Credit with Carers Premium as Caring for Sister? 

    Carers Allowance wouldn’t be payable if State Pension is higher than Carers Allowance, but underlying entitlement is often processed so the Carers Premium can be added to Pension Credit.

    No they do not receive Pension Credit, they are not eligible for PC.

    I am pretty sure my sister only gets ESA(IB) and the Premium for being in the support group.

    Once I have been registered as the appointee I will contact the DWP as I can sort it out with them.
    100% certain they will want more info, but I have all of that.

    Anyone in the support group should automatically get the EDP as well.

    As has been stated above, you should be able to get the SDP backdated all the way. There is specific provision in the regulations to allow full backdating despite the change of circumstances being reported late.

    Once the SDP has been sorted, make sure to ask for any transitional protection which will then become due in her UC claim. (Even if DWP say it is too late to get the regular transitional element because the entitlement to SDP was only discovered after migration, you should still then be able to get the transitional SDP element.)

    Just a quick update.

    It would appear my sister is receiving the Disability Income Guarantee.

    Mum was awarded AA from March 2024 and dad had his from 2023.

    So I will be requesting the SDP from when mum started receiving her AA.

    I will also make sure any transitional element is on her UC when they have this up and running.
