Moorside Letter before claim

Hi,
Back in June 2021, yes June 2021!!
We parked in Swansea Parc Tawe to go bowling at Tenpin.
We arrived 30mins prior to our booking as per the request from Tenpin (I still have the email) due to covid restrictions and social distancing.
We gave our reg to the colleague on the desk to gain the extra parking.
6 of us bowled, we all ate and had drinks which I have receipts for.
During our stay, our alley broke diwn twice!!
Anyway, a few weeks later, we re received a PCN from Alliance parking for overstaying 26 minutes over the allowed 2 hours.

I went into Tenpin the next day to complain.
They told me to appeal and explain and it will all be ok which I did.
Alliance would not accept our appeal on tbe grounds that only the driver can appeal and we had not named them!!
During this time I found out through a 3rd party that the Ipads Alliance had issued to business' on the Park were not recording information correctly so there were lot's of cases like mine.
I returned to Tenpin and they told me that all pcn's for a certain date range would be cancelled due to the error on the recording of reg's on the system so I did no more.

Fast forward 4 years and I've reveived 3 letters from Trace debt revovery for the amount owed!!
!!!!!!??
I ignored them of course but now I've had a letter before claim from Moorside legal so I'm not sure what to do next??

I'd really appreciate some help with this please.

Many Thanks

D

The claimant has 6 years to sue, so 4 years is nothing at the moment

Follow the LoC response template advice in the second post in the newbies sticky thread in announcements near the top of the forum by coupon mad,  email that response,  do not fill in any paperwork,  just one email

Then start preparing for the inevitable court claim in a month or two,  we will assist you throughout

    Welcome!

Nowt to worry about but open all letters promptly. Read post 2 of the Newbies FAQs thread, which we won't link because

    a) we want you to hop around, read some threads and be confident when navigating the forum, and

    Ok,

    Thanks for the help.

I've copied and added our details to the email template.

It says I can add my reasons for disputing the claim. Should I add something or just send the email as is??

It wont make any difference,  but my advice is to save your ammunition for the proper fight, not the preliminary

The urge to explain can be counter productive,  I presume you know what a "no comment " interview is  ?

I do have one question before we proceed..
If this does end up in court, my wife as the registered keeper does not want to go. l, on the other hand am more than happy to go and fight. Will that be possible?

No, but you can assist her, assuming that it actually gets to a hearing in civil court,  so you can be there with her

Although they may issue a court claim,  court is not inevitable,  more likely that they will discontinue before the hearing fee needs to be paid , don't mix up the two , one does not necessarily lead to the other

Why hasn't she named  you as the driver then? If true.

If she gives the name and postal address of the driver NOW, as part of the LBC reply, they have to send you a PCN and start again.

If they don't do that, she then has a perfect defence because she transferred liability.
