Is a retaining wall different from a garden wall, in insurance terms?

Hi All.

Storm floris has taken out my back wall which I believe is a retaining wall as the neighbour is slightly higher up than us, 
The neighbours fences were on the wall, we just bought the house so not ideal. My house insurance says in the policy they won't cover garden walls but is a retaining wall different? 

I have put the claim in but its been referred as its a new policy as we only moved last month. I had the same company at my old house so a bit annoyed this is a referral reason we need to wait 5 working days for a yay or nay any ideas? 

The home report classed this as a 2 saying it would need work in future but not urgent or dangerous obviously that's not the case.

    Who owns the wall?
    Your solicitor should have gone thought the the deeds and explained.

    it sounds as though it is a retaining wall if land higher on one side, a garden wall would be freestanding.

    if your neighbours fence was attached to the wall this could be a contributing factor to collapse as panels would act like a sail
