Horizon PCN

Hi

I received a parking notice from Horizon and after reading through the various posts and threads have put together an appeal, would someone be able to check over this to make sure my understanding is correct.

Dear Sir or Madam,

Re: Parking Charge Notice number [insert Parking Charge Notice number]

I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement, and there will be no admission as to who was driving and no assumptions can be drawn.
Since your Parking Charge Notice is a vague template, I require an explanation of the allegation and your evidence. You must include a close-up photograph of the sign you contend was at the location on the material date, as well as your images of the vehicle.

If the allegation concerns a payment machine, the data supplied in response to this appeal must include the record of payments made – showing a partial vehicle registration number – and an explanation of the reason for the Parking Charge Notice, because your notice does not explain it.
If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

In addition I refer to the following points within the BPA Code Of Practice.

3.1. Signs
3.1.1.
An entrance sign must be displayed and maintained at the entrance to
controlled land to inform drivers as appropriate whether parking is permitted
subject to terms and conditions, 
3.1.2
The entrance sign must display:

a) the fact that terms and conditions apply to accessing/parking on the site;

b) whether payment is required, or whether free parking is only available for a
limited period;
c) the name of the parking operator;
d) the logo of the ATA to which the parking operator belongs; and
e) where payment is required, whether on-site cash payment is available.
f) Private land
The entrance sign must not imply an invitation to park where public parking is
not permitted.

- There are no signs on entry to the car park, supported by the attached images and certainly one that follow the prescribed information.

- In addition, there are no road markings defining at what point the private land commences.

5.1 Consideration Period
and
5.2 Grace Period

- I require a copy of the contract between the operator and the land owner to confirm the allowances for the Consideration and Grace Periods.

-In addition, the contract is required to confirm the operator has permission to act on behalf of the landowner and the particularly as Iceland Kingstanding (known to be Iceland Frozen Foods) has confirmed the land in question belongs to a third party and not Iceland Frozen Foods.

7.3 Use of photographic evidence

Photographic evidence must not be used by a parking operator as the basis for issuing a
parking charge unless:

b) the images bear an accurate time and date stamp;

-The photos attached to the PCN are not date and time stamped and a date and time has been added below the image therefore the accuracy of this addition requires the operator to confirm this was correctly transferred from the image detail and if this a manual or automatic addition to the PCN.

I did email Iceland and they responded advising they could not do anything as the land is owned by a third party, shame as they are clearly happy to lose our business for the same if 20mins.
I was also going to add we were delayed exiting due to a small accident in what is a small car park but we have no evidence of this.

Any assistance is appreciated.

    Why not just use the standard appeal written in BLUE text for you in the NEWBIE sticky with no additions, deletions or amendments?

    The danger of adding anything extra is that you might inadvertently admit to driving.  Just use the appeal as written as is; the likelihood is that they will reject it anyway.

    Sent my appeal to horizon on 13/08/25 and they have cancelled it, not sure if it was due to the content of my appeal, mostly including above, or because I went I to the store and complained to the manager who agreed to speak to Horizon.

    Thank you for your recent correspondence regarding the above Parking Charge, which we have reviewed.

     

    I can confirm as a gesture of goodwill the Parking Charge has now been cancelled and no further action will be taken in this matter.

     

    Please note further Parking Charges may not be cancelled.

     

    Please see attached a copy of our entrance signage detailing the terms and conditions for parking onsite. 

     

    Please note that once the Parking Charge is cancelled the contact details are removed from the Parking Charge and will not be retained for any purpose or shared with third parties.  We are, however, required to retain images and appeal correspondence for a period of 2 years by DVLA and the BPA and are not therefore able to delete these from our system.
