Your Dad will have to ring that court because that Order makes no sense.

It says the hearing date is in two days time, yet it says the witness statement & evidence deadline is in October! This MUST be clarified tomorrow so Dad must stay on the phone.

(You should already know he has to do a WS and evidence, it's explained in some detail in the NEWBIES thread. But that hearing date must be wrong).

When is the hearing? It clearly wasn't this week. What did the Defendant find out?

    hey both,

I'll preface by saying me and dad weren't prepared for this whole process and apologise in advance for what may be frustrating decisions and outcomes for the readers.

the hearing was last Thursday, the night before we sat down and decided to ask chatgpt a bunch of stuff. Im not keen on using AI but I also didn't know what to do and had been busy with work the last few weeks to come on the forum or get anything done.

The judge was pretty dismissive, asking my dad why he hadn't brought his witness statement and evidences to the hearing on the 24/9 even though the court order said it had to be submitted by 5/10. Dad didn't really know what to reply except for "I had until the 5th" and the hearing went ahead.

Dad did mostly ok I think but we didn't win, the judged waved the "debt collector fee" as well as the representative fee, but we've got to pay the original fine of £100 and the £112 for various other court/hearing fees.

Is there anything else to do at this point? I couldn't find posts for if you lose the hearing. If there is some kind of appeal process, we might give it a go..

Strictly speaking, its over with, no free appeal process

The defendant should pay the lawyers the £212 total amount ASAP, in full, if he wants to stop a CCJ from being recorded in a few weeks time
