wrong price tag help!

Can anyone tell me if a retailer can refuse to give me a sale item that has been wrongly but clearly marked down by accident?

Thanks in advance Cheryl

Yes, they can refuse. I'll try to dig up info on it, but it isn't outside the realm of possibility

I believe they are within their rights to withdraw it from sale but I am no expert.

Yes, they can remove it from sale when you try to buy it.

Yep, they can withdraw it from sale.

I think they have to withdraw the item for 24hours before the can sell it again at the correct price.

    :)
Sometimes it's important to work for that pot of gold...But other times it's essential to take time off and to make sure that your most important decision in the day simply consists of choosing which color to slide down on the rainbow...

the price is called "offer or invitation to treat" in law (google the term for more details), it is only an offer to sell, and the contract is not actually made until you offer payment and the trader accepts.

Up until the trader actually accepts payment they can refuse to sell the item.

  • Thanks for your replies. Thats that then lol. They did say something about taking it off the shelves for 24 hours. I was almost sure they had to sell at the price it was offered as it would have been misleading if that was the only one left.

    Thanks again, Cheryl

Does a shop have the right to refuse to sell goods?"
Yes! Goods on display in a shop are there for you to make an offer to buy, the shop is not obliged to accept your offer. The same applies where goods have been labelled with the wrong price; the shop does not have to sell at that price.
