Hi all,

I received a PCN for “non payment”. I paid and put my registration number in but the card payment was declined and I paid by coin. I reasonably imo expected this to be all part of the same transaction however the parking company say that it wasn’t and as I didn’t re-enter my reg details, they have no record of my cash payment and therefore my payment was not valid.

They have accepted (18months later) that I paid with coin but will not budge on the fine.

My arguments are 1. That their processes were at fault in allowing the payment to progress without reg details and therefore printing of a ticket without a reg and 2. That their reason for fining me has changed significantly from ‘no payment’ to ‘no registration’ - had this been the case from the beginning I MAY have decided to either pay the original and discounted fine, appeal etc. but I was denied this opportunity.

They don’t accept my arguments and we are due to go to court soon.

Thoughts?

thanks

We are in 2025 the age of technology their system should have safeguards in place for this.
You paid their machine failed but printed a ticket which I hope you still have so the landowner received the appropriate fee for parking, in addition the scammers have admitted you paid by cash as a back up.
I think a judge would see that you did everything to fulfil your part of the contract.
You are dealing with useless chancers that always reject appeal they only make money by targeting people like this.
But please note there is no "fine" it's just an attempt to charge for and alleged breach of contract.

Good you found how to reply.

Yes even MPs have said motorists should not be getting pcns for failures in parking operators equipment.

Which parking company and Legals are representing them?

A hearing may not happen cases are often discontinued just before the court fees are due to be paid. See this thread

It’s The Parking Space (tariff St, Manchester), represented by BW Legal.
