2nd Charge on property - Creditor Liquidation/Debt sold to Azzurro

Hi all, I am back with more information and the matter is still unresolved. I found through PWC that the interim second charge was sold to Azzurro/Solaris Law since July 2021. I sent an email to both early last year and sent a final notice on 6 October 2025 after which I received a response from Solaris Law. The final notice was sent because we asked HM Land Registry (HMLR) to remove that charge but they could not do so without
To my shock and dismay, Solaris Law sent me the final charge order and a redemption statement in excessive of £10.7 k! They could have done this last year when I first approached them and the interest wouldn't have accrued as I would have settled it, which I am still wanting to do, but the interest is excessive and Solaris Law has refused to negotiate.
This makes me very angry as they could have replied sooner. We have been through absolute hell with the eviction notices. I had to ask my local MP and they helped suspend the 3rd eviction which Santander refused to suspend prior to this. I am on my 3rd mortgage offer with 2 having expired. All this uncertainty, stress and humiliation for Solaris Law to tell us on the 6th October that there is a final charge!!
The issue is that the final charging order has not been registered with the HM Land Registry (HMLR). The title register also shows the interim charge only and HMLR confirmed this over the phone when I called them. The judgement debtor, my father passed away due to terminal cancer in September 2021. He had been dealing with major surgeries and chemo during this whole debacle.
No one from my family knew about the final order either before 6 October 2025 and I have been searching tirelessly and have been in suffering trying to find who owned the interim second charge for 2 years!
Ideally I would like to make an application to court to have this order set aside as it was not registered with HMLR but I am not sure if I can do this. I really don't mind if the order can be varied and the interest is taken off. This money can be used to pay something to my siblings who have financial interest in the property. The final judgment order was made in Feb 2018 so PCF Credit had enough time to register the charge with HMLR before selling the debt to Azzurro in July 2021 or before going into liquidation in June 2021.
What I am not sure is if I can still apply to the court as more than 7 years have passed and what kind of evidence I would need to provide to help my case.
So I am back here for help and advice on what my options could be. I don't want to give into this easily even though I know Santander could issue another eviction notice. I am angry because of reasons stated above. And the debt is not mine. And I need to save the family home. And I am getting into a lot of debt by taking out a mortgage to save it. And I don't want to pay a ridiculous amount of interest on the final interim charge. I really want this charge to go away!

My deceased Father's mortgage lender's representative were granted a repossession order and have sent a previous notice of eviction which was stopped. I am representing my Mother as she is the benefactor and I am also buying the house so that my elderly mother doesn't have to suffer from homelessness in her old age, has some money to relocate and a property of this size is difficult to find for me and my other half.
I have a mortgage ready but there is issue with a second charge on the property in favour of PCF credit limited who have gone into liquidation. Our solicitors and I have sent a number of emails to the liquidators but to no avail. We have been sent another notice of eviction and it seems the lenders are less likely to stop the eviction. The eviction date is set for 20th August 2025. Our solicitor needs some kind of information to provide to Land Registry so they can even attempt at having the second charge removed.
We are so stuck and do not know what to do. Every passing moment is killing us and we really do not know where to go for help.
Can someone please help!

I’d be concentrating on getting the eviction order removed and dealing with the repossession hearing. The second charge is less important.I'm a Forum Ambassador on the housing, mortgages & student money saving boards. I have spoken to my mum's solicitors and they have advised not to agree to pay them. The second charge is 'interim' and PCF Credit LTD never applied for a final charging order so they have now contacted Land Registry to have the charge written off.
I will post an update as I find out more.
