Euro Car Parks NTK/PCN - Pub Parking

Hi guys, I received a NTK/PCN today from Euro Car Parks for pub parking - I have a digital receipt that I was a customer at the pub and I have drafted a bit of a template based on some searches on the forum - could you tell me if this is OK to use please?

Subject: Appeal against Parking Charge Notice [PCN Number] – Vehicle Registration [XXXXXXX] – The Newbridge, Wolverhampton

Dear Euro Car Parks,

I am the registered keeper of the above vehicle and wish to appeal the Parking Charge Notice issued at The Newbridge, Wolverhampton. I request that the charge be cancelled on the following grounds:

1. No Evidence of Who Was Driving & No Keeper Liability
You have not identified the driver, and I am under no legal obligation to name them. As the keeper, I am only liable if you have fully complied with the Protection of Freedoms Act 2012 (Schedule 4), which you have not. There is no presumption in law that the keeper was the driver. Unless you can show full POFA compliance, you cannot pursue me as keeper.

2. Inadequate Signage and No Contract Formed
The signage at The Newbridge is unclear and insufficient to form a contract with drivers. There was no clear notice of the parking terms, maximum stay, or the parking charge. [If you have photos, reference them here.]

3. No Evidence of Landowner Authority
You have not provided evidence that you have the necessary authority from the landowner to issue and enforce parking charges at this site, as required by the BPA Code of Practice.

4. ANPR Reliability
The ANPR system’s reliability and accuracy are in question. The BPA Code of Practice requires that such systems are maintained and accurate, and you have not provided evidence of this.

5. Genuine Customer
I was a genuine customer at The Newbridge on the date in question. [Will Attach proof.]

For these reasons, I request that you cancel the charge. If you reject this appeal, I require a POPLA code so I can escalate the matter.

    Plan A in the newbies sticky thread in announcements would be better,  and quicker,  than an appeal 

    But do not miss the appeal window,  so appeal before the deadline 

    Presumably the driver didn't register the VRM details inside the business   ?

    I believe so - but it wasn't clear that this was the procedure. Can always pop back into the pub and ask them I think that's a good shout.
