Claim form from DCBL for 2 parking invoices

The problem with the DCBL claim is that it is FAKE ? They have added £140 and called it damages ? WHAT DAMAGES ? don't they mean debt collection charges to line their pockets ?

With the dispute resolution ahead, do not think that this is final, it's not. You will disagree with DCBL and that you will not pay. . You ask where the word DAMAGES comes from as it will not be on any signs

You dispited this so it cannot go further until the judge rules on the case

Again if it goes that far, DCBL still have explain what the DAMAGES is all about.

A judge will see this as a feeble attempt of double recovery which is not allowed.

So, as DCBL already know this, just before the court date, they discontinue and that saves them getting a court spanking where you can claim costs

The questions I have are:
Is it unusual for DCBL to proceed to this point and beyond. I received 2 calls from DCBL since I received this call asking me to settle for less. An invitation I declined.

No. This is perfectly normal but they won't be likely to send anyone if this is a 30 minute in-person hearing.

2. The documents I have to exchange - is it the sum of all the documents I have sent before including the pictures of the lighting conditions and the signs? Is there anything else you think I need to send? As part of this, do I need to outline my defence or just send the documents I will use as part of my oral defence?

You shouldn't have sent anything to court yet, except a defence & N180 form. Obviously the NEWBIES thread covers WS & evidence stage, which is NOT just repeating the defence but we don't need to repeat all this on case threads.

3. As they are pursuing two parking charges, they made a mistake and stated incorrectly on the claim form (its in a previous message) that both instances were for parking in a disabled bay. One of the notices they sent me was for parking on a verge. Therefore they cannot provide any evidence for the 2nd disabled bay. Does the entire claim fail when the second notice fails because they were lumped into one claim?

No but one of the PCNs does (if you argue this point well) because the allegation in the POC is wrong and impossible for them to evidence. And they can't switch horses to a new allegation later. It WASN'T pleaded as parked on a verge so that PCN falls away. But you have to say that.

4. I note i can apply to have the order set aside. Is that worth doing, especially with the error of point 3 above.

No. Why on earth would you want to pay money to (fail to) set aside the order for a DR hearing, and annoy the judge?

5. If I don't receive their documents by the 14 days before the hearing, can I complain on a process point?

Yes but they will, because this is a free 'mini-hearing' for them. They love a 'free hit' at convincing a judge with papers written by someone who does it for a living, versus a scared consumer.
