  • Emailed our DQ to both the CNBC and Elms Legal.
    Had a letter from Elms Legal. They don't accept anything via email.
    Must we post a written DQ to them or is the fact that we have served the DQ via email sufficient.
    I don't really see how it's our fault that they haven't managed to drag themselves into the 21st century.
    Appreciate any guidance.

    What does it state on your N1SDT claim form as "Address for sending documents if different"?  Follow those instructions.  Don't know why companies like ELMS and others play the "we don't accept anything by email" card when they clearly have an email address!
  • Thanks for your reply. It gives a postal address for ELMS Legal. I'll just post a copy to them at that address.
    I'm assuming they don't accept email, just to be petty and difficult I suppose.

    I believe there are permit holder only bays as well general use pay and display.
    I believe she inadvertently parked in a permit holder only bays.
    This is one of the photos they took.

    That is the only indication. There are no specific markings or signs indicating which particular bays are permit only.

    She cannot have been in breach anyway because a licence is only offered to e-Permit Holders. See PACE v Lengyel.

    If you read plenty of Excel or VCS Elms Legal cases on the forum, you'll see Elms soon drop out of the process now that you've poker faced them, leaving the Claimant running the case. It's what they do.

    Whilst your answers must of course be your own, there are vital points to safeguard motorists interests to make, that many people may not think of without our guidance because we see cases every day and we know the legal background. 

    However, people like you have lived & breathed the intimidation, greed and unfairness first hand so your voice is needed!

    I've already completed the consultation this month. However my daughter will also be completing her own version of the consultation as well.
    Anything to ensure these parasites are brought into line can only be a good thing.
