Failed to update keeper's address on V5

I've looked at the newbie's thread but it doesn't mention this situation.

I recently separated from my wife and moved to a new county. I parked in one of these places and did not receive the initial letters bacause in all the mess I forgot to change the adress on my V5.

I have been suffering from mental health issues as a result of the situation (documented).

The first I knew of the parking charge was a letter to my new address from a company called Trace Debt Recovery.

I used their online response form to ask for the details of the original parking company but they have refused, told me I now owe £170 and say they will not enter into further communication.

I realise it's my fault I did not change the address on my V5 but feel that the stress I've been under and my mental health issues might be at least an avenue where I might request leniency - but if they refuse to enter into any more correspondence - what happens next?

I'm a pensioner and can hardly pay the bills, let alone these extortionate charges.

However, the reason for my post is that they can (rightly I guess) say it's my fault I did not receive the initial letter because I hadn't changed my address on the V5. But I can;t find anything specific in the newbies thread to cover this.

Advice greatly appreciated.

    The DVLA require the V5c log book to be correct,  so you could receive a fine of up to £1000 for not doing so, from the DVLA via the magistrates courts,  so get it done ASAP if you have not done so already 

    The same applies to your driving licence too, so do both if necessary 

    Rest easy if its been done, better late than not at all  ( sorry to say but yes they would say that and it is correct,  it was your responsibility,  so not their problem,  plus it could have been worse if you had outstanding toll charges,  bus lane fines, speeding notices or council notices,  ULEZ charges etc   )

    The letter from Trace should have the client details on it, namely the parking company name 

    Do not pay Trace Recovery

    Hi - thanks for your reply - yes I have now corrected the error and applied to have my V5 updated - irritatingly I did my driving licence at the time but didn't think of the V5. Lots of stress at the time... the letter does have the parking company name and in the email they sent in reply to my online query they have included the original letters from the parking company UKCPS. I note your comment not to pay Trace, but I am worried at the rapid escalation of the amount!

    They claim UKCPS will not enter into correspondence with me - is that correct?

    Its correct,  chances are that UKCPS will pass the case on to Moorside Legal now that you have been traced 

    The amount is £0 unless a judge awarded a sum in a civil court hearing against you,  not happened yet  ( the figures are purely on paper,  nothing official   )

    Email a Data Rectification Notice to the DPO at UKCPS where you inform them of the correct address for the service of papers and that they must erase the old out of date address from their records  ( because you don't want court papers to go to the old address   )  add copies of proof of the correct address,  like 2 redacted utility bills or similar 

    Then await a Letter of Claim giving you 30 days notice from Moorside Legal and use the LoC template response in the second post in the newbies sticky thread in announcements near the top of the forum 

    Then await a possible or probable N1SDT court claim pack from the CNBC in Northampton using MCOL to arrive in the post in the next few months 

    Use this thread of yours for further information and guidance,  as required 

    Don't fret about it,  because UKCPS were never going to cancel the pcn anyway

    Thanks so much for your input. I don't have an email address for them - nothing on their letters or website either - is normal, post-office mail OK?

    Trace don't want to help you as they want your money, you don't pay the idiots anything and they have no power to do anything as you don't have an actual debt only some silly company claiming you owe them something for breach of contract.
    UKCPS have a no win no fee contract with Trace so they won't accept any correspondence about this until Trace give up and hand it back.

    Its definitely on their website on their privacy page,  where it should be,  look towards the bottom and it's there, in green , under your data protection rights

    I hope you realise from reading Moorside UKCPS threads that you'll never pay this?

    Come back when you get Moorside letters. Do not ignore a Claim Form.

    No worries but you do need the old address erased by all parties. DO NOT PHONE OR OTHERWISE ENGAGE WITH TRACE EXCEPT TO GET THE ADDRESS UPDATED.

    Fantastic! I've emailed both UKCPS and Trace with the title "DATA RECTIFICATION NOTICE" to ask them to delete my old address. i shall now wait till (if?) I get a LoC. Thank you so much for your help.
