Group Nexus

Options

Hi all,

I recently received a parking fine in the post from Group Nexus for parking at New Square (West Bromwich). I know the rules have changed, it used to be free if you spent £5 in the shopping centre, but now you have to pay regardless.

Anyway, I made sure to pay before leaving. I scanned my ticket at the machine and it said I owed 80p for my stay (I was there less than an hour), which I paid via my banking app, so I have proof of payment.

The PCN letter claims I either didn’t pay or underpaid, and says I was parked for 1 hour and 2 minutes. But according to Group Nexus’ own website, there’s a 10-minute grace period. I know from the machine to my car and driving off, it was definitely within that.

Unless there was a glitch when I paid (which wouldn’t be my fault), I believe I’ve done everything right. I paid what the machine told me to. I’m planning to appeal this because it’s just ridiculous.

Has anyone had success appealing something similar?

Any tips on what to include or how to word it?

Thanks in advance

The contract has been formed and completed. They quoted 80p, accepted it and consideration has been exchanged.

If that differs from any signage, then their variation of the contract is on them.

By all means appeal, stating this and include proof of payment. Expect them to fob you off. They'll probably just say they have no reason to believe the machines were faulty on that day, so pay up. Then you can go Popla if you wish.

But nothing to lose. You're not going to pay them.

    Yep, you'll never pay this.

See the NEWBIES FAQS thread for the appeals stages.
