ECP legal action after use of faulty parking meter

Options
Hi, I am in need of some advice. It seems that my fight with Euro carparks is never ending.  I have gone through the newbies thread but have not been able to find answer to the following questions:

question 1:
- if there was an fault in the parking machine and only printed the receipt and not an actual ticket and thought payment was taken and you are now been taken to court over it. what legal recourse do you have at this stage? and what is the success rate in seeking redress in faulty parking machines legal action?

question 2:

-If you had a valid ticket but overstayed by 9min or so because you were accompanied by an elderly person and made initial appeal to euro carparks but had no response back but they are now looking to escalate the matter to court, what can you do?

    1) I doubt that there is any redress,  whatever that means

The fact is that ECP have given DCB Legal tens of thousands of old claims,  from within the last 6 years, which are being pursued with an LoC followed by a court claim against the victim using MCOL

People who fight back usually find that ECP via DCB Legal discontinue just before the £27 hearing fee is due, at that point it's over with

    2) the BPA Code of Practice allows for a minimum of 10 minutes grace period at the end of an authorised parking period

you should follow the advice in post 2 in the newbies sticky thread in announcements near the top of the forum,  so please study it carefully ,  Do you have an LoC from DCB Legal giving you 30 days notice   ?

Ps,  Their PDT machines are notorious for being unreliable

And you already know some of their tactics in your CCJ set aside thread

You are dealing with greedy scammers that try any old dodge to relieve people of their cash many cave in those that fight their bullying tactics don't pay a penny.
As Gr1Pr states above follow the newbies thread, the fact that their pay machine was fault is not your fault it's theirs why should you pay any more you have a receipt to prove it. The cynical might think this is one of their scams don't forget they don't get the parking fees, they only get the income from PCN's!

The onus is on them to prove their machine worked if you declare that it was faulty, not the other way around.

All pretty moot though because ECP will always discontinue defended single ticket cases whenever they use DCB Legal.

Yep none of it matters! It's easy.

Just defend any DCB Legal court claim using our template. They'll discontinue months later.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
