Another DCB Legal post but with a twist

I recently got court papers through from dcbl regarding my motorhome being parked in a retail car park for more than the stated time. I said to my wife we shouldn't pay it as it's ridiculous but relented. I have a screenshot of the bank payment with the reference number matching up but today have got 'Proposed Allocation to the Small Claims Track' paperwork to fill in. I have no issue with this as I can show the courts that I have paid this debt, albeit they are making a claim for £85 + costs whereas I paid £100.

Now on to the twist part, in todays mail my wife has received the 'Final Notice of Debt Recovery' letter for a parking charge from 2020! What actually happened was that we pulled in to a car park, went to the payment machine and it was broken. I went to the second machine and it only took cash so I went back to see if my wife and I between us had enough. We didn't so drove off.

I firmly believe that they are only now chasing this older 'debt' because I am prepared to go to court for the newer one.

Any advice for dealing with these parasites that's not illegal?

    Presumably you have submitted a defence to the claim form, so name the parking company involved 

    Post a redacted word for word copy of the defence you submitted,  plus a redacted picture of the POC from the lower left of the claim form below after hiding the VRM details first 

    Your partner should ignore the powerless debt collectors letters,  post 4 in the newbies sticky thread in announcements

    The one from 2020 has likely come to light as they check what debts are on the books that might hit the statute limit date.  That it's been sent to your wife now at the same time you are about to go to court is a coincidence.

    No, the one going to court is UK parking control ltd and the one from 2020 is smart parking

    The court claim is with DCB Legal but the parking firm is UK parking control ltd.

    My word for word defence is "I was sent a letter from DCB Legal for the costs and claim of £100. I paid this on **/**/****, reference number - ******.*******

    They won't have joined the dots. They are dealing with tens upon tens of thousands of cases each week. You're overthinking this. Deal with the court claim. 

    If you receive a Letter Of/Before Claim, or a County Court Claim via the Northampton CNBC, come back on a brand new thread for further advice.
