    i have only done N180 questionnaire and sent it to DQ and CEL, i am not sure about WS and deadline for it. today i have got email for Mediation appointment which is in November. have i missed the WS?? i am bit worried now.

    It seems like it is another of those early witness statements from Scott Wilson; search the forum for Scott Wilson and bookmark the threads you find so you can keep up with what other posters have been advised to do.

    We hope you should already know from reading IMPORTANT: KNOW WHAT HAPPENS WHEN' in post 2 of the NEWBIES thread, that you get to provide images and evidence now.

    This is is WS & evidence stage. Deadline for that will be in your Hearing Order and the fact that theirs has now arrived rings alarm bells.

    Recent good WS that you can crib from include the one by @aza123, where they included as evidence, the transcripts for the Chan & Akande cases that you need too.

    Thank you. I would like to clarify my current situation to ensure I am aligned with the required steps:

    • I have not yet received a Hearing Order. The only correspondence I’ve received so far includes:
    1. An email from CEL the other day with their Witness Statement.
    2. An email today confirming the Mediation appointment. Given this, I am unsure if I may have missed the Hearing Order or any associated deadlines.

    I just had a mediation appointment (CEL) and offered £10 as advised on forum. However, as expected, the offer was not accepted. As mentioned previously, Scott Wilson has sent me an early pre-signed Witness Statement (WS). I now need to wait for the Hearing Order before preparing my WS and evidence. is this correct? Please advise on the next steps. Thanks

    Correct,  wait for the case to be transferred to your local civil court and the CNBC have informed you about the transfer

    Your local civil court will send you a court order containing the information and deadlines,  all perfectly normal so far, so stop worrying

    I am looking for advice and guidance on preparing my witness statement (WS) for a case that has been transferred to my local civil court. I received a court order stating that I need to submit my WS soon. The Claimant alleges that I overstayed the permitted parking time by 8 minutes in a private car park managed by Civil Enforcement Limited. I have already received the Claimant’s WS (prepared by Scott Wilson, their General Counsel), which I previously shared here for reference.

    My Defence Summary:

    1. History of Parking at the Location:

    • Heron Foods opened in 2020, and I have been a regular customer.
    • Parking was historically free with no issues or charges until parking restrictions were introduced (unknown to me).
    • At the time of the alleged parking contravention, a large sign outside the Heron Foods store clearly stated “Free Parking for Customers”, with no mention of restrictions or charges.
    • I was unaware of any changes to parking management or restrictions introduced by the Claimant.
      • The Claimant has not provided sufficient evidence that clear and visible signage was in place to notify customers of the new parking restrictions.
  • Mitigating Circumstances:

    • After completing my shopping at Heron Foods, I received an emergency phone call, which required immediate attention.
    • This call caused my stay to extend to 1 hour and 38 minutes, exceeding the allowed parking time.
  • Issues with Claimant’s Case:

    • I believe the signage was inadequate and not prominently displayed, so I was unaware of any contractual terms.
    • The Claimant’s WS relies on the Protection of Freedoms Act (POFA) 2012, but I believe they have not fully complied with POFA requirements, such as correctly issuing the Notice to Keeper.
    • The additional £70 charge for "debt recovery" seems excessive and unfair under the Consumer Rights Act 2015.
  • What I Need Help With:

    Thank you in advance for your help! I’m feeling a bit overwhelmed, but your advice will make a big difference.

    POFA is not relevant as you stated in your Defence:-

    "The Defendant has little recollection of events, save as set out below and they were the registered keeper and the driver of the vehicle."

    Don't forget no actual breach was pleaded on the Claim form  -  hence the Chan and Akande cases stated in your defence filed.
