So we are due to get some. It’s a 4 way split house sold around 4 weeks ago and person now living there. The funds are in solicitor account. Not sure what the delta is there’s definitely nobody owed any debt. Obviously nobody can say when we will get it here but my worry is this drags on years? They did suggest months but I’m not sure if that’s the usual process? We don’t want to ask too many questions to the solicitor but no idea why they need to take months as they have our bank details now?

    You are paying for a service and a polite enquiry from a beneficiary about what remains to be done and when the solicitors estimate they'll be able to release funds and is perfectly reasonable.

    Who is the executor? Solicitor, or someone else?

    When my Mum died it took about 6 months to sell the house and clean up all the finances and get the cheque in my bank. My Mum's solicitor was the executor, but myself and my brothers kept in regular contact and were largely responsible for getting the house sold ie cleaning the house and working with the agent. So please communicate with your solicitor, they should be glad to talk and keep you up to date.
    And so we beat on, boats against the current, borne back ceaselessly into the past.

    Has she asked what the timeline might be?
    As the one paying and the Executor, she should be best placed to get answers quickly ( hopefully) .

    Then you could ask her to ring the solicitor, and if she doesn't feel comfortable doing that then ask her if it's ok that you do.

    Solicitors don't mind giving updates on how things are going. It's when people stew for ages and then ring up in a temper demanding answers that relations sour.

    A simple phone call will probably give you all the information you need and put your mind at rest.

    It can be difficult to comment or  to estimate as the time taken could well depend on  responses from other agencies, such as HMRC and the particular details of the Estate.

    You should not underestimate what might be the activities to be done and the time that take. That will depend upon the complexity of the estate ( as well as the work rate of the solicitor!).
    Can we assume ( as the house has been sold) that the estate has been through probate?

    As an example ( just one ) HMRC needs to be informed that the property has been sold ( within 60 days of sale) and if it has realised more than the value for probate then HMRC need to agree any tax ( Capital Gains tax) due. HMRC are not the fastest at responding.

    It is probably only the solicitor who will be aware of the full extent of the activities to do ( if the Executor is not ) so as advised earlier in the thread  that legal professional is the best first place ( If not the only port of call ) to ask.

    Certainly nobody on this board has the detail of the Estate or the Will ( if there is one ) to give anything other than general comments.
