Admiral Car Insurance

Has anybody had issues with Admiral refusing to deal with third parties? 

(And is this actually allowed?)

Back in June, another driver caused an accident in which my car was written off. My insurers acted quickly and paid out, minus my excess, and they confirm the Admiral (the other party's insurer) have admitted liability.

Now here's where the trouble starts,  now that the other party is at fault, I should be able to now claim my excess back right? 

Stupidly, I did not have legal cover and so I am having to chase them myself for this.
I have phoned several times and have been given the automated message 'we are unable to deal with third parties or representatives right now'. I have also emailed twice and both emails have been ignored.

Do I now pursue legal action against Admiral and if so, can I add my legal fees to the claim for them to pay?

    Nope, you pursue legal action against the driver and they pass it to Admiral to deal with. 

    In other words you can't sue Admiral directly as your claim is against the driver.

    Hi, thanks for your reply. I did initially think this however the police wouldn't give me his details so i've nothing to go on annoyingly.

    Have you spoken to your insurers about where they are with making their recovery? 

    If your only uninsured loss is your excess then they may be willing to recover it for you despite you not having paid for LE cover; in my claims days the difference between recovering outlay only and outlay plus excess was a single tickbox on a generic communication and half the people did it by default without checking if the person had LE cover or not (a better system probably wouldnt allow it). 

    You claim is against the driver; legally when you have a unsatisfied judgement against them then you can legally push Admiral to deal. Most deal well before that but they arent technically obliged to

    Hi, thank you for your response. My insurers just tell me I need to recover it myself from Admiral but I'll get back on to them tomorrow to see if they've had any joy with recovering costs. Obviously I need to claim closed ASAP so hopefully they will give them a nudge either way.

    Hi all, 

    Thank you again for your comments here.

    Some good news (I hope). I contacted my insurers following this and they added my excess to their chargeback with Admiral. They said they will initiate legal proceedings against them and include my excess with the claim so it's just a waiting game for now. At least it takes the stress away for the time being.
