Council issued ticket with Private Parking Sign

Hi All,

I received a ticket from the council PEO on a small patch of land that clearly shows a private land/private parking controlled sign.

I appealed the ticket on the basis the PEO was outside their jurisdiction.

The council has come back stating the sign is for a different car park. I parked directly below the sign, albeit for some bins in the way.

I now have to wait for the notice to owner to contest the verdict further.

Do I have a legitimate appeal or am I wasting my time?

As we major on private parking tickets here, Free Traffic Legal Advice (FTLA) forum will be your best bet for council penalty charges. Register there but please note that a Hotmail address may not work - try using a throwaway Gmail account instead if you do have trouble registering, and post a new thread; here's your link:

Read the sticky 'Read this first before posting your case' as well as reading through some of the other threads there ahead of posting your own details, to get the hang of what information they need from you in your opening post - but as a minimum you will need to post redacted photos/scans of all correspondence you've received from the council (both sides, if appropriate), as they need to see all the small print, and a Google Street View link.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

No one on here can tell you that without knowing the site details exactly, though even if private property you were still chancing it.
The photos which show very little information, look as if it is the entrance to a building site, and maybe that was a roadway now blocked off and could be council.
The sign could be relating to the piece of land to its left PPC signage is rarely compliant to the COP let alone any common sense who knows.
You could do a land registry search on the building behind for a couple of quid which might throw up something though.

So did you not notice double yellow lines?
But did you not notice that the OP said the signage appeared to indicate it was private land?
(With the sign being non-compliant in that it was damaged so parts were unreadable.)

There might be some come-back in that the lines are heavily worn/damaged/faded, which might suggest that they have fallen into disuse.
A quick web search suggests that there seems to be varying comment/advice regarding this.
