Claim form Recieved but no letter of claim prior to this

Evening all.

Forum has been a great help previously, helping me beat a prior case involving these cowboys and i once again thank all those previously involved.

Anyway, I have received a claim form through the post, I was away on holiday and by the time i returned it was over 5 days so did the initial MCOL part.

My question is: As a LOC was not received prior to the claim form being received, i'm unsure whether to use the CEL v Chan paras 1 through 6 in the first part of my defence, followed by the other paragraphs in the Template defence thread.

The reason being the claimant is Parkingeye however, I do not know if it is DCBL acting on their behalf as the LOC was not received.

    The LoC is largely irrelevant now that a claim form has been issued 

    The top left of the claim form gives you who is involved,  the second box down on the left is where DCB Legal details could be,  or it's an in house case via their litigation department  ( no dcb legal   )

    So check it,  because the answers are there , regardless of any LoC 

    Study the POC to see if the alleged breach is there,  if it is then I don't think that you can use Chan and Akande

    Yes you do.

    The Claim Form (on the left) either says 'ParkingEye' twice or it says 'ParkingEye as the C but paperwork to DCB Legal.

    If it is the former, PEye will have added £25 or £30 to the PCN sum for no justified reason: show us the bottom half of the claim form.

    Cover the MCOL PASSWORD on the right.

    So the claim is in house,  no dcb legal,  because the latter aren't mentioned 

    What is the issue date from the top right of the claim form  ?

    Tricky one this, unless you are a member of staff? Perhaps in a different car that day?

    Are the signs still Car Parking Partnership instead of Parking Eye?

    Still getting over covid and the brain fog is out of this world, thanks for the redacted version.

    So to follow this one up, My wife was adamant that the correct car park was parked in as no notable signage at the time advising otherwise. Also when she paid it noted on the payment machine that she was parked in a public car park - not the staff car park, and a picture was fortunately taken of this on the payment machine.

    Say that in para 3 of the template defence and add the extra wording you find when you search the forum for:

    ParkingEye added £30 defence

    Always change search to sort by NEWEST.
