Dcb legal, Letter of Claim, query

Options

Hello all, long story short, I have four Euro Car Parks PCN’s dating from August last year and have received a letter of claim by DcbLegal for two of them, amounting to £340. (curiously, the middle two, in chronological order).

On each occasion I parked in the same car park (Browncross St, Manchester city centre) and have a ‘void transaction’ receipt – I just didn’t appreciate that my payment had not gone through and have some supporting evidence.

I don’t want to take up anyone’s time with too much detail, but I wanted to ask the collective wisdom of this board, if:

  1. Disputing the fairness/legality of ‘paid’ and ‘void transaction’ receipts, given they are almost identical, is a valid reason to take to a judge/court hearing?
  2. Isn’t any court claim supposed to ‘roll-up’ all disputed PCN’s? ie will I now get another letter of claim for £340 for the other two outstanding PCNs and have to go through all this again?
  3. Finally, the DCB Legal letter of claim directs me to their website to ‘complete and submit the reply form and financial statement’. However, this is an online form headed, ‘LOC Response Form’ with a separate box headed ‘Your enquiry’ and max word count 2000 characters and no option to provide financial statement.

Having read, I think, the relevant parts of the newbies thread, can I just check that I should email them back with the template/standard ‘Letter of Claim’ response and await court action?

Many thanks for any advice.

    1) it certainly could be,  if it actually gets as far as a hearing,  many are discontinued beforehand

    2) correct,  so if they tried a second claim for 1 or 2 more , then you have estoppel on your side , Henderson and Henderson

    3) Email them is much preferred , either way do not fill in financial forms
  • OK, thanks very much for the response, much appreciated.
