Sorry for the screenshot however, I have arthritis and have sent this email to MSE who advised to post on the forum I hope you can help.  In addition my friend contacted a few law firms who have declined to assist on the matter.Thank you in advance

    So, your friend bought a car, and the paperwork showed what work was carried out at each MOT, however one MOT when it initially failed the paperwork was not included - this in itself is not an issue - you can't demand the paperwork of work done.

    You then say he paid all the payments til the end of the agreement in April 2025 - so I presume he bought the car in 2022?

    He now has the car on his driveway.

    If he has paid the finance in full - what are the finance company chasing him for?

    If it's 3 years old - I'm not sure what help he wants.

    However if I've misunderstood the facts - please advise as it's seems more to this than your copy and paste.

    So he bought an ex-lease car on finance or he has leased a car and there is no finance involved?

    How old was the car when they purchased it? How long have they had it since?

    You say the finance finished in April 2025 so why is the finance company demanding money for scrapping the car?

    Why are the finance company chasing? Have they stop paying due to the problems?

    Is there not someone (friend who's car it is) that can type this out for you, as sorry to say makes little sense.

    Sounds like PCP.

    "The car wasn't valued anywhere near that"
    Sounds like the finance company have valued it far less than the GFV because of "Major issue that would cost £8000 to fix" so can't hand it back.

    It's now sat on a drive somewhere with the finance company chasing them for the GFV but they don't want to pay it as the car has gone bang.

    Yes I understand that the finance company aren't owed any money however, the dealer phoned him has he could not afford the cost to repair it they suggested he had over used the car 😉 and that he would have to pay the £8000 of course this wasn't possible so the car remained with dealer until he made the final payment he then had to pay to have it transported to his home the finance company are saying he hasn't fulfilled the agreement ie he didn't give it back but the dealer wouldn't take it back. The finance company are now saying they will scrap it the figure they have now demanded is £4000 to scrap it. He has written to the Ombudsman mid May but no response yet 
    He just needs help to advise if ge has any legal rights.

    Short version: Somebody's had a car on finance (of some kind) for three years, and now it's broken. The thing that's broken was previously an MOT fail before they got the car, but repaired. Whose problem is it?

    Am I reading it right?

    Let's give a similarly short answer - it's not the financier's. Nor is it the supplier's.

    The more you say the more confused the situation is getting... suggest you get your friend to post themselves or at least have them sitting with you so you can remove the contradictions/mud from your story. 

    If it was on finance which ended in April but he's keeping/bought the car then its nothing to do with the finance and if he went over the mileage on a PCP wouldnt matter because he retained the car. 

    If he was leasing car then there is no finance so it ending in April but he still has the car doesnt add up.

    I think perhaps this is a PCP - and the payments have been made but rather than pay the balloon payment the OP's friend wants to hand the car back - but the dealer won't take the car back as it's knackered.

    The finance company will take the car back and dispose of it - but it's going to cost him £8k
