We are almost at the end of the house buying process. Three months in and our solicitor is still not able to solve our problem.
A small slither of land in front of the house and highway forming the parking is unregistered on land registry . The lender said they wont lend unless the boundary is updated . We reached out to the HMLR and they rejected the request for adverse possession as suggested by our solicitor because it is just a 7 year old property and it needs min 12 years to ask for such a claim.
The sellers solicitor has suggested indemnity insurance as a solution but the bank may not accept it.
now getting close to 4 months and we dont know if the bank will lend.
Any one dealt with anything like this.

This same property?If so, my comments would be the same, the adverse posession route wasn't likely to help much - you need clarification on where the highway boundary is, and if that isn't in the same place as your property boundary then you need to find out who owns that strip of land. With a good possiblity it is this property and the boundaries aren't accurately reflected in the title.0
