    The first one is the defence template (new) and the second one is not a defence anything, it is the start of a witness statement.

    Blimey, good job i double checked.  I could have sworn that was the old defence template, when i started it a couple of weeks ago.  Thanks for the clarification.  My little brain has really struggled with this
